The problem with Dagenais, and the Supreme Court's view that the courts should be open, is that lower courts consistently trample on this view. In the past couple of years the organization I work for has pointed to Supreme Court decisions when seeking access to records, only to have lower court judges perform legal contortions to justify closinng public access to court materials. Sadly, it takes tonnes of money to fight back - something most news organizatoins and people don't have. Not to mention the time. We've done it and have won - but often by the time the battle is over the story is long gone, so the system has really beaten us. In a recent case we're still fighting the lawyers and judge even misread a previous case we won to further their blocking our access to court exhibits. No wonder many Canadians don't understand and, in my view, distrust the justice system.
